Welcome to Swim Masters Swim School. 

We  guarantee to provide safe, quality swimming lessons that build  confidence and ability, using qualified swimming teachers at all times.  It is important for all members of Swim Masters Swimming School to agree  and adhere to our Terms & Conditions and Code of Conduct, detailed  here: 

1. Acceptance and Enrolment of Terms and Conditions 

1.1  By enrolling or attending a swimming lesson with us, you accept these  terms and conditions set out in this document and they will form a  binding contract between you and us. 

1.2  You will ensure that you follow the general swimming pool rules set out  at the end of this document and also follow any rules that are set out  by individual swimming facilities.

1.3 We reserve the right to vary/amend these terms and conditions at any time upon reasonable notice.  

2. Bookings 

2.1  Bookings may be made by email and social media websites, and  shall operate on a first come first served basis. Our swimming lessons  are highly in demand, so  we are unable to hold any spaces. 

2.2  The start date, start time, venue will be set out in an invoice which will be emailed to you after you have booked on to  swimming lessons. 

2.3  All swimming lessons will start promptly at the stated time on your  invoice. If you arrive late to the pool, the lesson will not be extended  and will end at the agreed time. 

2.4  Full payment is required with the enrolment form. A place cannot be  guaranteed if payment is not received during the designated time frame,  which is set out on your invoice. 

2.5  We shall try to accommodate any request to change your day, time,  location or swimming teacher with notice, however this shall be at our  discretion and we shall not be obliged to provide any credit or refund  if an alternative lesson is unavailable. 

2.6  There will be a maximum of 5 pupils per swimming lesson. If the class  you would like to join is full, you will need to join out waiting list.  This can be done via email and also our social media  page. 

3. Payment

3.1  Payments can be made via bank transfer a late booking fee of 10% will need to be added to your invoice  amount if the dealine is missed. 

3.2 If paying by bank transfer, please use your Childs full name as a reference so it is easily traceable.  

4. Medical 

4.1  Medical conditions must be disclosed to Swim Masters Swim School  regarding the health of you, your child or those that you have placed  into swimming lessons with us. All information received is treated in  confidence and with sensitivity. 

4.2  If your child misses a swimming lesson because of an illness, you must  inform us before the child’s lesson, you will NOT receive a refund  however your child may be eligible for a catch up lesson. This is  subject to availability.

4.3  Following on from a sickness bug, we request that your child is clear  of symptoms for at least 48 hours before they return to swimming  lessons. 

4.4  It is YOUR responsibility to ensure that you or your children are  medically safe to swim. We shall not be liable for any accidents or  injuries that arise from swimming with us that relates to your  individual medical conditions. 

4.5  If a swimmer has broken a limb, required an operation or has been given  a medical reason as to why they cannot attend swimming lessons, then a  refund for the lessons missed may be considered. However, this is  subject to a doctors note being received and sent to us. Only the  remaining weeks of the current term will be refunded. Weeks cannot be  backdated for missed lessons. Balances can also be carried over to the  following term if you require. However, any refund that has been  requested, will be given only at the discretion of Swim Masters Swim School reserve the right to NOT refund at their own  discretion. 

5. Cancellation and Refunds

5.1  If you enrol with Swim Masters Swim School and pay the full invoice  amount and change your mind about having swimming lessons before lessons start, you will be  entitled to a refund for what you have paid minus a 20% admin fee. You  will need to cancel with us within 5 days of sending us payment to be  entitled to your refund.  All refunds that have been accepted and issued  will reach your bank account within 30 days of acceptance. 

5.2  You must inform Swim Masters Swim School if you no longer want or  require your swimming space that you have booked on for. If you cancel  your space after the start of the term then no refund will be given.  This also applies if your child refuses to get into the water or you  change your mind. 

5.3  Classes that you do not attend will NOT be refunded by Swim Masters Swimming School or carried over to the following term, however you may  be eligible for a catch up lesson if there is space in another class on a  different day. There is a maximum of 1 catch up per term. 

5.4  Any cancellations due to power cuts, adverse weather conditions,  disasters, terrorism, war and pandemic will not be refunded as these are  out of our control. We will do our best to find you an alternative  lesson. 

5.5  Should a lesson already be in progress or due to start and you need to  leave for any reason, Swim Masters is under no obligation to refund for  the lesson. 

5.6  If you wish to take a holiday during the term, you will still be  charged for the full term. You will have your option of a catch up  lesson if a space is available and you will still keep your place on the  course. 

5.7  If we determine that there is insufficient support for a lesson, we  have the right to cancel, suspend or postpone the lesson before it  starts. We shall give you as much notice as possible should any  cancellation occur, and we will provide you with a credit for your  lesson if no suitable session is found. Our liability for any such  cancellation shall be limited to this credit and we shall not be liable  for any losses of any kind incurred by you as a result of cancellation. 

5.8  Money credits will only be issued in the event of 5 or more credits on  your account or a medical condition. Please refer to section 4.5. Any  less than 5 credits will be issued via credit note, which can only be be  used by the child who’s name is on it. It will only be valid for 1 year  from the date of issue. If you have decided not to renew your space  then all credits will still be valid for the use of the child and will  NOT be refunded. You will only have your credit note to use within the  swim school. 

5.9  If you wish to cancel your space with Swim Masters and you have already  paid for the term, please see section 5.1. However, if you request a  refund during a time of war, terrorism and pandemic we will not offer a  refund as the swim school will also be closed and we will only offer a  credit note to which you will be able to use at another time which is  convenient for you. 

5.10  If for any reason you cannot make a lesson we will try our best to  accommodate a catch up lesson for you however these cannot be  guaranteed. If we cancel a lesson due to a teacher illness or the pool  is unsafe, we will give a credit on your swimming account which will be  deducted off your next terms invoice. 

5.11  If you decide not to re enrol with Swim Masters you will be offered a  credit note, should you have any credits with us. There will be NO  refunds issued, even if the credits were accrued by a teacher illness or  a pool closure. 

6. Re enrolment 

6.1  Customers who swim with Swim Masters Swim School will be allocated a 7  day priority slot to re-enrol for swimming lessons for the next term.  This will ensure that your day, time and location will stay the same.  Payment should be made before the day slot is over to guarantee the  above. If no payment has been received your space will then be allocated  to another swimmer. 

6.2  All other spaces are allocated on a first come first serve basis.  Payment is due before the allocated date on the invoice. Term dates and  times will also be on your swimming schedule. 

6.3 If you have chose not to re-enrol with Swim Masters Swim School, please see section 5.9.

7. Photography and video footage 

7.1  Please note, due to child protection regulations photography and video  filming is not permitted when there are adults or children in the  swimming pool other than your own. 

7.2 Official photoshoots are offered by Swim Masters Swim School throughout the year for which we obtain signed consent. 

7.3  All Swim Masters Swim School photography, logos and illustrations are  the copyright of Swim Masters Swim School. Any reproduction of any of the  above without a written agreement will be regarded as being in breach  of our copyright and dealt with accordingly. 

7.4 You may not take or reproduce photographs or videos of pupils or any lesson held. 

8. Limitations of liability 

8.1  Whilst every reasonable precaution is taken by us to ensure security  and safety at our swimming lessons, we shall not in any way be held  liable for any loss or damage arising in anyway from our swimming  lessons or the swimming pools we use. However, nothing in these terms  and conditions shall limit the liability of any person for deaths or  personal injury caused by negligence. 

8.2  Any claim against us arising from attendance at one of our swimming  lessons must be notified to us in writing within 3 months from the day  of the relevant swimming lesson and we shall not be liable for any claim  that is notified to us after this time. 

8.3  In any event, we shall not be liable to you; for any purely economic  loss, for consequential or indirect losses or for any loss of profit or  opportunity; (where the claim is insured) for any loss which we are  unable le to recover from any insurer; unable to recover from that third  party; and for any loss, which is greater than the few paid by you for  the relevant course of swimming lessons. 

8.4  In the event that you or your child causes harm, damage, loss or injury  to any other person or property during the course, you agree to  indemnify us and reimburse us for all claims, losses, damages, expenses  (including legal fees), and any other liability suffered by us as a  result of such harm, damage, loss or injury caused by you or other  pupils. 

8.5  We shall not be liable for any loss or theft of your personal  possessions and all property left at the property (including without  limitation in the changing rooms and in the car park) is done so at your  own risk. 

9 Data protection 

9.1  All personal data given to Swim Masters Swim School as a result of  enrolment and re enrolment will NOT be passed on to any third party and  will be kept secure and confidential in the swim school office. 

9.2  Any personal data such as photographs of your child will not be used  for any advertisement or promotion without consent and notifying the  parent/guardian before use. 

10. Parking

10.1  All of our swimming pools are on private properties and therefore you  must supervise  your children/child at all times inside and outside of  the swimming pool facility. 

10.2  Please respect the properties you are around and ensure that you park  in the allocated parking spaces and not on any grassland (unless  otherwise instructed).

10.3 We are not liable for ANY damage caused to your vehicle whilst at the facility and therefore we take no responsibility.

11. Lost property

11.1  Swim Masters Swim School take no responsibility for any damage or  missing items or property left on the premises including the pool  grounds and car park area. 

12. Responsibility 

12.1  All users of the private swimming pools should familiarise themselves  with the specific pool rules. Parents and guardians are responsible for  their children/child at all times whilst on the swimming pool premises.  Children should not be left unattended at ANY time whilst on the  premises. 

12.2  Inside of the swimming pool, the floor and other surfaces may be  slippery and therefore you should take necessary precautions to ensure  yours and your child’s safety at all times. Any accidents/incidents  incurred on the swimming pool premises should immediately be reported so  an accident report form can be filled out and filed. As a result of  injury. Swim Masters Swim School shall not be held liable for any  personal injury or fatality occurs.

13. Private Lessons

13.1  Booking Structure

• The initial booking is a 6-week block

• After this, lessons will renew in rolling 4-week blocks

• Payment is required in advance to confirm your place

13.2  Cancellations and Charges

• You will not be charged if you provide more than one week’s notice for a missed session

• If notice is given of one month, the final two lessons of your block will not be charged

• Any cancellation with less than one week’s notice will be charged in full, as your space is reserved

13.3  How to Give Notice

Please let us know via message or email with at least 7 days’ notice. We’ll take care of everything from there. 

13.4 If you decide to cancel your lessons and you haven't given one months notice then you won't receive your payment in advanced back as this is a deposit for the lesson. 

Please  note, Swim Masters Swim School reserve the right to update or change  these terms and conditions at anytime. However, you will be given notice  of these changes as and when this happens. 

Swimming pool code of conduct 

 

  • Swimmers should not eat for at least 1 hour prior to swimming.
     
  • Please arrive for your swimming lesson on time.
     
  • As  a general rule of thumb, do not enter the pool area prior to your  lesson start time. Whilst you are waiting for your lesson to commence  please keep poolside noise down to a minimum so that all lessons can  take place with a quiet and calm atmosphere. 
     
  • Only enter the pool (water) once your instructor has invited you to do so.
     
  • Listen to what your instructor tells you. If you do not understand, please ask.
     
  • The  following action is seen as disorderly behaviour; running, diving,  jumping, ducking, fighting, bombing, shouting and throwing items. If you  are warned and behaviour persists you will be asked to leave. 
     
  • Do  not dangle babies into the water at the side of the pool, you may be  asked to leave the pool area and not continue your session if it occurs.
     
  • Swimming goggles, including those with ophthalmic prescription lenses, may be worn at the wearers own risk. 
     
  • To  avoid injury, the wearing of spectacles in the water by a swimmer  during a session is not recommended. Care of spectacles is the  responsibility of the parent/guardian.
     
  • Jewellery can be a hazard and should not be worn during swimming, including earrings.
     
  • Appropriate swimwear should be worn at all times in the swimming pool and communal changing areas.
     
  • During  lessons parents/guardians must not interrupt or communicate with the  teacher, distract the pupils or approach the poolside, unless it is a  matter of health and safety or emergency. 
     
  • Please ensure long hair is tied up.
